These SMS Terms ("SMS Terms") govern your enrollment in and use of the Journey Rewards SMS messaging program (the "SMS Program") operated by Journey Rewards Inc. ("Journey," "we," "us," or "our"). These SMS Terms supplement and are incorporated into the Journey Website & App Terms of Use and the Journey Rewards Loyalty Program Terms & Conditions. Capitalized terms not defined here have the meanings given in those agreements.
1. Program Overview
The SMS Program delivers two distinct categories of text messages to enrolled mobile telephone numbers:
1.1 Service Messages. Transactional and account-related messages necessary to operate your Account and deliver the Program, including: one-time passcodes and authentication codes; security and fraud alerts; reservation and itinerary confirmations and updates; Points-posted, Credit-Points-clearing, and Status-change notices; award confirmations; account-status notices; partner-exit re-accommodation notices; and notices of material changes to Journey's terms. Service Messages are sent based on the contractual relationship between you and Journey when you create an Account and verify your mobile telephone number, and are not subject to marketing opt-in or opt-out preferences. You may not opt out of Service Messages while maintaining an active Account; closing your Account is the mechanism for ceasing Service Messages.
1.2 Marketing Messages. Promotional messages including early-access alerts for new Alliance Partners, member-rate drops, curated trip ideas, partner promotions, and similar non-essential messages. Marketing Messages are sent only if you have provided prior express opt-in consent for marketing texts, separately from any other consent. Consent to Marketing Messages is not a condition of Program membership, purchase, or receipt of any other Journey service.
2. How to Enroll in Marketing Messages
To opt in to Marketing Messages, check the marketing-texts box during signup, in your Account preferences, or where otherwise offered. By opting in, you consent to receive Marketing Messages from Journey at the mobile telephone number you have provided, sent using automated technology including automatic telephone dialing systems and similar technology. You represent that you are the subscriber to or customary user of the mobile telephone number you provide.
3. Message Frequency
Message frequency varies based on your activity, Status, and opt-in preferences. Service Messages occur as needed to operate your Account (typically several per month for active Members). Marketing Messages occur on a campaign-driven basis (typically a few per month).
4. Cost
Message and data rates may apply. Standard message and data rates from your mobile carrier apply to messages sent and received under the SMS Program. Journey does not charge for participating in the SMS Program, but you are responsible for any charges from your mobile carrier. Contact your carrier for details about your plan.
5. Commands and Opt-Out
5.1 Help. Reply HELP to any message from Journey to receive support information. You may also contact [email protected] or 1 (888) 990-4712 for assistance.
5.2 Opt Out of Marketing Messages. Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any Marketing Message to withdraw your consent to Marketing Messages. After you opt out, you will receive one final confirmation message acknowledging that you have been unsubscribed, after which no further Marketing Messages will be sent to your number unless you opt back in. You may also withdraw consent at any time through your Account preferences or by contacting [email protected].
5.3 Opting Out Does Not Affect Service Messages or Membership. Opting out of Marketing Messages does not affect your Account, your Program membership, or your receipt of Service Messages. To stop Service Messages, you must close your Account.
5.4 Channel-Specific. Opting out of Marketing Messages on SMS does not opt you out of marketing emails, push notifications, or other marketing channels. To manage other channels, use the unsubscribe mechanism in those channels or your Account preferences.
5.5 Timing. Journey will honor opt-out requests in accordance with applicable law. In the United States, opt-out requests are processed within ten (10) business days at the outside, typically within minutes to hours.
6. Supported Carriers
The SMS Program is available on most major US wireless carriers, including AT&T, Verizon Wireless, T-Mobile, US Cellular, Sprint (T-Mobile), Boost, Cricket, Metro, and others. Outside the United States, availability depends on Journey's SMS provider's coverage and your local carrier's support. Carriers are not liable for delayed or undelivered messages. Journey is not responsible for messages that are delayed, undelivered, or filtered by your carrier or device.
7. Eligibility
You must be at the age of majority in your jurisdiction of residence to enroll in Marketing Messages. The SMS Program is not directed to children. The SMS Program is not available to, and may not be enrolled in by, any person who is a resident of, ordinarily located in, or enrolling from any jurisdiction subject to comprehensive US, UK, EU, or UN sanctions, or any person identified on any sanctions, denied-parties, or restricted-parties list maintained by an applicable governmental authority.
Journey may, in its sole discretion, limit, suspend, or deny SMS Program enrollment in any jurisdiction where Journey determines that the SMS Program creates unacceptable legal, regulatory, fraud, or operational risk.
8. Privacy
Journey's collection, use, disclosure, and protection of personal data (including your mobile telephone number and message-related metadata) is described in the Privacy Policy. Journey works with third-party SMS service providers to deliver messages. Those providers process your mobile telephone number and message metadata on Journey's behalf under written data processing agreements that restrict their use of your information to delivering the SMS Program. Where required by applicable law, Journey relies on appropriate safeguards (such as the EU-US Data Privacy Framework, UK Extension, or Standard Contractual Clauses) for any cross-border transfers.
9. International SMS
Where the SMS Program is available outside the United States, additional or different consent, frequency, cost, or content disclosures may apply based on local law. By enrolling in Marketing Messages, you consent to the receipt of messages in accordance with these SMS Terms and any additional disclosures presented at enrollment for your jurisdiction. Local-law revocation mechanisms and timeframes apply where they differ from those in Section 5.
10. Two-Way Messaging Limitations
The SMS Program supports limited two-way commands as described in Section 5 (HELP, STOP, START). Replies to Service Messages or Marketing Messages other than these supported commands are not monitored and may not receive a response. 11. Changes to the SMS Program and These SMS Terms
Journey may modify the SMS Program or these SMS Terms at any time. Material changes will be communicated through the Services, by email, or by SMS in advance of the effective date where required by law. Your continued participation in the SMS Program after the effective date of a change constitutes acceptance of the change. If you do not agree to a change, you may opt out under Section 5.
12. Disclaimers
THE SMS PROGRAM IS PROVIDED "AS IS" AND "AS AVAILABLE." JOURNEY DOES NOT WARRANT THAT MESSAGES WILL BE TIMELY, ACCURATE, COMPLETE, OR UNINTERRUPTED. Journey is not responsible for messages that are delayed, undelivered, misdelivered, or filtered by carriers, devices, or third-party services. The disclaimers and limitations of liability in Sections 11 and 12 of the Journey Website & App Terms of Use apply to the SMS Program.
13. Disputes; Arbitration
Disputes arising out of or relating to the SMS Program are subject to the dispute resolution, arbitration, class-action waiver, governing-law, and one-year time-bar provisions in Sections 14, 15, and 16 of the Journey Website & App Terms of Use, except where applicable consumer-protection laws in your jurisdiction of residence give you mandatory rights to bring claims in local courts or before local authorities, in which case those rights apply.
