By enrolling in the Journey Rewards Program or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

These Program Terms govern the Journey Rewards loyalty program (the "Program"). Your general use of Journey's Services is governed by the Journey Website & App Terms of Use. Earning specifics by Alliance Partner category and channel are governed by the Journey Rewards Earning Terms, which are incorporated by reference. To the extent of any conflict between these Program Terms and the Earning Terms, these Program Terms control with respect to the matters addressed here; the Earning Terms control with respect to channel-specific and partner-specific earning detail.

1. Program Overview & Acceptance

By creating a Journey account or otherwise enrolling, you agree to these Program Terms. The Program rewards eligible activity at Journey Alliance Partners — including Alliance Hotels, Alliance Residences, Alliance Restaurants, Alliance Boutiques, and Nominated Partners — plus other qualifying activities Journey announces from time to time.

2. Definitions

  • Points: The Program's unit of value, issued by Journey and earned and redeemed in accordance with these Terms.
  • Status: A Member's tier in the Program, based on Points earned in the qualification period.
  • Alliance Partner / Host Property: A participating operator, property, restaurant, boutique, café, bar, experience provider, or other merchant or service provider in the Journey network. Alliance Partner categories include Alliance Hotels, Alliance Residences, Alliance Restaurants, and Alliance Boutiques.
  • Nominated Partner: A partner whose offerings appear in the Journey ecosystem under separate commercial arrangements with Journey, where earning is funded by Journey as a customer-acquisition incentive rather than as a contractual Program obligation, as further described in the Earning Terms.
  • Account in Good Standing: An open Program account with no suspension, fraud hold, or material violation.
  • Member: An individual with an active Program Account.
  • Qualifying Activity: A transaction or event at or with a participating Alliance Partner that meets the conditions disclosed by Journey for the applicable earning method, as further set forth in the Earning Terms. Qualifying Activity includes Qualifying Stays at Alliance Hotels and Alliance Residences.
  • Non-Qualifying Activity: Activity that does not meet the conditions for Qualifying Activity, including transactions at Non-Qualifying Rates. Non-Qualifying Activity does not earn Points or Status credit.
  • Non-Qualifying Rates: Rates that do not earn Points or Status credit, as further set forth in the Earning Terms. May include wholesale, tour-operator, opaque OTA, coupon, voucher, complimentary, corporate, group, travel-agent, certain online travel portal, certain credit card portal, and otherwise designated ineligible rates.
  • Credit Points: Points awarded in a restricted state, redeemable only for designated purposes until they clear in accordance with Section 5A.
  • Cleared Points: Points that are no longer restricted and may be redeemed for any available reward.
  • Service Communications: Communications necessary to operate a Member's Account and deliver the Program, as further set forth in Section 13.
  • Marketing Communications: Promotional communications subject to a Member's stated preferences, as further set forth in Section 13.

3. Eligibility; Enrollment; Access Paths

3.1 Eligibility. Membership in the Program is free and available to any natural person who:

(a) possesses the legal authority and capacity to agree to these Program Terms and has reached the age of majority in their jurisdiction of residence;

(b) resides in a jurisdiction whose laws permit participation in a loyalty program of this type, and whose participation is not prohibited or restricted by applicable law (including any employer or governmental gift, ethics, or anti-corruption rules to which the individual is subject);

(c) is not a resident of, ordinarily located in, or accessing the Program from any jurisdiction subject to comprehensive US, UK, EU, or UN sanctions, including but not limited to Cuba, Iran, North Korea, Syria, the Crimea region, the so-called Donetsk People's Republic, and the so-called Luhansk People's Republic;

(d) is not identified on any sanctions, denied-parties, or restricted-parties list maintained by the US Department of the Treasury's Office of Foreign Assets Control (OFAC), the United Nations, the European Union, the United Kingdom, or any other applicable governmental authority;

(e) provides valid and accurate personal information at enrollment and verifies at least one contact method (email address or mobile telephone number) via one-time passcode;

(f) is not already a Member of the Program; and

(g) has not previously been terminated from the Program by Journey.

3.2 Reserved Discretion. Journey reserves the right, in its sole discretion, to limit, suspend, or deny enrollment, earning, redemption, or other Program participation in any jurisdiction or to any individual where Journey determines that participation creates unacceptable legal, regulatory, tax, sanctions, fraud, abuse, or operational risk. This right may be exercised on a country, region, individual, or transaction basis, with or without notice, to the extent permitted by applicable law.

3.3 Verification. Journey may verify eligibility, identity, residency, and source of funds at enrollment and at any time thereafter, including by one-time passcode (OTP) confirmation, validation of mailing or billing address, requests for government-issued identification, screening against sanctions and watchlists, or use of third-party verification services. Providing false, inaccurate, or misleading information is a material violation of these Terms and grounds for Point forfeiture and Account closure.

3.4 Early Access; Invitations. Prior or current guests of Alliance Partner properties and their invited members may receive early access invitations. The Program is expected to open more broadly over time, subject to Sections 3.1 and 3.2.

3.5 Account in Good Standing. Certain earn rates, Status benefits, and Member-only offers may require enrollment before booking and an Account in Good Standing at the time of stay or qualifying activity; otherwise, the stay may earn at a non-member rate or not at all.

3.6 Employer, Government, and Enterprise Eligibility. You are solely responsible for confirming that your enrollment and receipt of Points, Status, benefits, awards, and Program communications complies with applicable employer policies, government ethics rules, and laws governing gifts, gratuities, or rebates. Where your employer or governing body restricts loyalty benefits, you should not enroll, or should designate Points consistent with those rules.

3.7 Relocation. Members are responsible for notifying Journey of a change in country of residence. Relocation to a jurisdiction excluded under Section 3.1(c) or restricted under Section 3.2 may result in suspension or closure of the Account; where permitted by applicable law, Journey may offer to redeem unredeemed Points at the Point Floor Value Guarantee rate (Section 6.5) prior to closure.

4. Status Tiers & Qualification

4.1 General. Status is based on Points earned each calendar year (January 1 – December 31 at 11:59 PM local time of the Member's billing address). Unless otherwise stated, once achieved, Status is retained for the remainder of the calendar year in which it is earned and through the next calendar year.

4.2 Activities Excluded from Status Qualification. The following do not count toward Status qualification: balance transfers; cash advances or cash-equivalent transactions; gift card or stored-value purchases; person-to-person payments; tax payments; cryptocurrency or digital-currency purchases; refunded, charged-back, reversed, or fraudulent transactions; Points awarded as welcome bonuses, referral bonuses, courtesy or goodwill bonuses, sweepstakes or contest winnings, survey participation Points, and other non-spend-related Bonus Points; transactions on Non-Qualifying Rates; transactions at Non-Qualifying Activities; and other transactions designated by Journey as ineligible for Status credit at the time of activity.

4.3 Tier Changes. Journey may add, modify, or discontinue tiers, thresholds, or qualifying activities prospectively, subject to Section 15.

4.4 Day 0 Status. Journey may provide "Day 0" status, defined as a gifted status level. When status levels are gifted, the terms governing the longevity of the gifted status will be stated and may vary from earned-status terms.

5. Earning Points

5.1 Points Issued by Journey. All Points are issued solely by Journey. Points are a limited promotional credit denominated and tracked exclusively by Journey, and represent a limited right against Journey, subject to and as set forth in these Terms. Members have no vested rights, ownership interest, or property interest in unredeemed Points. The use of the word "earn" and similar language in these Terms and in Journey's marketing does not imply that Points have monetary value prior to successful redemption, nor that any amounts are owed to Members. Points have no cash value, do not constitute property, and are not redeemable for cash. No interest accrues on Point balances. Unless redeemed in accordance with these Terms, Points remain the property of Journey.

5.2 No Partner Liability for Points. Alliance Partners and Nominated Partners do not issue Points, do not maintain Point balances, and have no liability of any kind to Members in respect of Points, Status, awards, redemptions, or other Program benefits. Partners' role is limited to delivering the underlying goods, services, or experiences purchased or redeemed by the Member. Any claim a Member may have relating to Points, Status, awards, or other Program benefits lies solely against Journey. Any claim a Member may have relating to the goods, services, or experiences provided at or by a Partner lies solely against that Partner. Members acknowledge that Points are funded by commercial arrangements between Journey and Partners, that those arrangements may change at any time, and that no Partner is a guarantor, co-issuer, or obligor of any Program benefit.

5.3 Earning Methods; Discretion. Journey, in its sole discretion, determines the methods by which Points may be earned, the rates and multipliers applied, the categories of spend or activity that qualify, the channels through which earning is available, and the conditions under which Points are posted, held, adjusted, reversed, or forfeited. Points may be earned through one or more of the following methods, as Journey makes available from time to time and as further detailed in the Earning Terms: activity-based earning; rate-based earning calculated as Points per US dollar of qualifying spend; multipliers; fixed-amount awards; Bonus Points; channel-differentiated earning; and other methods Journey introduces. The applicable earn rate, multiplier, fixed amount, or bonus structure for any given activity will be that disclosed by Journey at the time the activity is initiated or, where Journey discloses a rate post-activity, at the time the Points are posted.

5.4 Channel Hierarchy; Minimum Earn Guarantee for Journey-Channel Bookings. Journey rewards Members differently based on the channel through which a booking or transaction is initiated. For bookings made directly through the Journey website (journey.com) or the official Journey mobile application at Alliance Hotels and Alliance Residences, Journey guarantees a minimum earn rate of five (5) Points per eligible US dollar spent, subject to the eligibility, exclusions, and timing rules in the Earning Terms. For all other bookings and transactions — including bookings made directly with an Alliance Partner outside the Journey channels, bookings made through online travel agencies or other third-party channels, and earning associated with Nominated Partners — Journey reserves full discretion over whether and how Points are awarded, and any Points awarded for such activity are treated as discretionary incentives funded by Journey as a customer-acquisition expense, as further described in the Earning Terms. No minimum earn rate is guaranteed for non-Journey-channel activity, and no Member is entitled to such Points by these Terms.

5.5 Non-Qualifying Activity. Only Qualifying Activity earns Points and Status credit. Non-Qualifying Activity does not earn Points or Status credit. The Earning Terms set forth Non-Qualifying Activity and Non-Qualifying Rates by partner category.

5.6 FX Conversion. Points are calculated in USD. For non-USD transactions, Journey or its processors may convert to USD at the time of transaction, posting, or settlement, and the rate used may differ from the rate shown on a folio, invoice, or receipt.

5.7 Posting; Missing Credit Timing. Points generally post in accordance with the timing rules in the Earning Terms (typically within 48 hours of qualifying activity for hotel and residence stays, validated within up to 28 days). If Points have not posted within the timing window described in the Earning Terms, contact support with receipts.

5.8 Promotions and Bonus Points. Bonus campaigns or partner offers may have additional terms and windows. Journey may limit, change, or end promotions at its discretion. Bonus Points awarded outside the standard earning structure (including welcome bonuses, referral bonuses, survey or marketing participation Points, sweepstakes winnings, and goodwill or recovery bonuses) do not count toward Status qualification.

5.9 Monitoring; Corrections; Negative Balances. Journey may audit Accounts and transactions at any time and correct balances, Status, redemptions, or benefits posted in error or obtained in violation of these Terms. Journey may place holds on or reverse awards pending investigation, and may claw back Points where the underlying transaction is refunded, charged back, reversed, or determined to be fraudulent or non-qualifying. If, after a correction, reversal, claw-back, or for any other reason, a Member has a negative Points balance, any Points the Member subsequently earns will be applied first to reduce the negative balance, and the Member will be unable to redeem Points until the balance becomes positive. Journey reserves the right to invoice a Member for Points received for which the Member was subsequently determined to be ineligible, and may seek to collect such amounts.

5.10 Multiple Rooms or Items. For stay-based earning, a Member may earn on up to two additional rooms (total three) with the same check-in/out dates if the Member occupies one room and all rooms are booked under the Member's name. Journey may cap award redemptions to three rooms per stay and cancel speculative or resale bookings. For non-stay activity, Journey may impose per-transaction or per-period caps on earning, which will be disclosed where applicable.

5.11 Missing Credit Claims. Submit missing-credit requests within twelve (12) months of the qualifying activity with proof of payment. New Members may claim credit for Qualifying Activity completed within thirty (30) days prior to enrollment if requested within twelve (12) months.

5.12 Cash + Points. Some awards may combine cash and Points. Members earn Points only on the cash portion, where eligible. Taxes and fees may apply to the cash portion and are the Member's responsibility.

5.13 Group & Events. Journey may award Points for eligible group events under a signed agreement. Earn rates, caps, and eligibility (including government and enterprise restrictions) will be stated in the agreement and may differ from standard earning methods.

5A. Credit Points and Cleared Points

5A.1 Two States. Points exist in one of two states: Credit Points (restricted) or Cleared Points (unrestricted).

5A.2 Default Restriction Period. Points awarded for Qualifying Activity at Alliance Partners are issued as Credit Points and convert to Cleared Points no earlier than forty-eight (48) hours after checkout or transaction completion, subject to confirmation of the underlying transaction by the Alliance Partner's property management system or system of record. Earlier conversion is permitted in the cases described in Sections 5A.3 and 5A.4 and as further detailed in the Earning Terms.

5A.3 Immediate Cleared Status for Non-Refundable Journey-Channel Bookings. For non-refundable bookings made directly through journey.com or the official Journey mobile application, Points associated with the initial booking amount (exclusive of any taxes and fees) are issued as Cleared Points immediately upon booking. Points for any additional on-property spend at the Alliance Partner are issued as Credit Points upon transaction and convert to Cleared Points in accordance with Section 5A.2.

5A.4 Cancellation-Window Conversion. For refundable bookings made directly through journey.com or the official Journey mobile application, Points are issued as Credit Points upon booking and convert to Cleared Points once the applicable cancellation or refund window has passed.

5A.5 Redemption of Credit Points. Credit Points may be redeemed only for the designated reward categories Journey makes available for Credit Points at the time of redemption. Cleared Points may be redeemed for any available reward subject to these Terms.

5A.6 Forfeiture on Reversal. Credit Points associated with a booking or transaction that is cancelled, refunded, charged back, or otherwise reversed are forfeited automatically without further notice. Cleared Points associated with a reversed transaction may be clawed back in accordance with Section 5.9.

6. Redemption & Awards

6.1 General. Members may redeem Cleared Points (and, where designated, Credit Points) for rewards Journey makes available from time to time, which may include discounted or award stays, upgrades, dining experiences, fee waivers, partner offers, and other experiences. All redemptions are subject to property or partner participation, availability, and confirmation. A redemption is not final until the applicable Alliance Partner or Nominated Partner confirms.

6.2 Suite Elevation. Select Members may use Suite Elevation awards for a confirmed suite (or next room category) upgrade at eligible properties, subject to availability and property confirmation. Some inventory or dates may be excluded.

6.3 Timeless Stay (Flexible Check-in/Check-out). Where offered, Members may use a Timeless Stay award for early arrival and/or late departure, subject to property participation, operational feasibility, and property confirmation.

6.4 Pet Perks and Fee Waivers. For eligible Members and at participating properties, pet-related fees, resort fees, and other property-imposed fees may be waived and/or credits offered, subject to property rules, availability, and property confirmation.

6.5 Point Floor Value Guarantee. Unless suspended under extraordinary circumstances, the redemption value of each Cleared Point will not be set below US$0.01 when comparing against the Alliance Partner's standard retail rate for the redeemed service. Promotional or negotiated rates may not apply to this comparison. Credit Points are not subject to the Point Floor Value Guarantee.

6.6 Award Cancellations. Property cancellation/no-show/early-departure rules apply to award stays. If cancelled within the free-cancellation window and the property confirms, Points will be re-deposited. Late cancellation or no-show may result in (i) property charges to the card on file and/or (ii) partial or full forfeiture of Points at Journey's discretion.

6.7 On-Property Credits. Where available, Members may redeem Points for folio credits during a stay. Partial redemptions may be disallowed; unused credit is forfeited; redemptions are final.

6.8 Sole Remedy. The sole remedy available to a Member in connection with any dispute relating to Points, Status, awards, redemptions, or other Program benefits — whether the claim is based in law or equity — shall be the crediting or re-crediting to the Member's Account of Points in an amount no greater than the Points at issue.

7. Transfers, Gifting & Pooling

7.1 Transfers. Where Journey enables it, Members may transfer Cleared Points to other Members or to third-party programs Journey supports. Once transferred and accepted, transactions are final and irreversible. Third-party program terms control once Points leave Journey's ecosystem. Credit Points are not transferable.

7.2 Pooling. If Journey enables Points "pools," the creator controls pool usage and allocations; Journey will not mediate pool disputes between contributors.

7.3 Gifted Award Stays. Subject to availability, a Member may book an award stay for another guest by naming that guest at booking. The guest must present ID and a payment method for incidentals. Gift recipients do not earn Points for the stay and may not receive Member-specific elite benefits unless the property elects to honor them. Journey may cap gifted award stays per Member per calendar year.

7.4 Death or Divorce. Upon verified death of a Member, Journey may, at its discretion, transfer the deceased Member's unredeemed Points one time to a single beneficiary (spouse or person designated in estate documents). In the case of a court-ordered divorce decree, Journey may transfer Points as ordered. Status and benefits do not transfer.

8. Prohibited Dealings; No Cash Value

Except as expressly stated, Points have no cash value and may not be sold, bartered, brokered, pledged, or exchanged for money. Points may not be transferred, assigned, or shared except as expressly permitted by these Terms. Journey may void Points acquired or used in violation of these Terms.

You are responsible for determining your eligibility to receive loyalty benefits under applicable employer or governmental gift policies and laws.

9. Member Conduct; Fraud and Abuse

Journey may suspend or close accounts, forfeit Points (including Cleared Points), cancel redemptions, and pursue all remedies available at law or in equity for any of the following:

(a) unauthorized buying, selling, brokering, or bartering of Points or awards;

(b) transferring or attempting to transfer Points to an ineligible third party or account;

(c) opening or maintaining multiple accounts to generate Points, Status, or rewards;

(d) manipulating, gaming, or attempting to circumvent Program earn or redemption mechanics;

(e) speculative, fictitious, or resale bookings;

(f) misrepresentation in enrollment, transaction, missing-credit, or redemption claims;

(g) misuse of payment methods, including chargebacks made without prior contact with Journey support;

(h) violation of these Terms, the Website & App Terms of Use, the Earning Terms, or applicable law; or

(i) any other conduct Journey determines, in its sole discretion, to be fraudulent, abusive, hostile, or inconsistent with the Program's purpose.

Journey's determinations under this Section 9 are final and binding. Journey may share information about suspected fraud with Alliance Partners, Nominated Partners, payment networks, and law enforcement.

10. Account Activity & Expiration

To keep Points active, complete at least one qualifying earn or redeem activity in any 24-month period. Accounts without qualifying activity for 24 consecutive months may forfeit unredeemed Points. Journey may offer courtesy reinstatements or exceptions at its discretion; fees may apply. Accounts with no activity for 5 years may be deactivated.

11. Taxes

Earning or redeeming Points may have tax implications. Members are solely responsible for any taxes, reporting, or disclosures arising from participation. Journey bears no obligation to provide tax documentation but agrees to provide limited support where requested in writing for tax-related matters.

12. Partner Participation & Property Terms

12.1 Property and Partner Terms. An Alliance Partner's or Nominated Partner's specific terms, blackouts, and house rules govern your stay or transaction and may limit or exclude certain benefits or awards.

12.2 Promotions. Promotions and partner offers are subject to change or withdrawal at any time and may be subject to caps, blackout dates, or targeted eligibility.

12.3 Participation. Not all properties or services participate in all aspects of the Program. Participation and benefit levels may vary and may change without notice.

12.4 Partner Exit. If an Alliance Partner exits the Program before an award stay is consumed, Journey will attempt to re-accommodate or re-deposit Points. Benefits or awards may not be honored by the former partner.

13. Communications & Notices

13.1 Service Communications. As a condition of operating your Program account, you agree that Journey will send you Service Communications necessary to deliver the Program, including: one-time passcodes and authentication messages; security and fraud alerts; reservation and itinerary confirmations and updates; Points-posted, Credit-Points-clearing, and Status-change notices; award confirmations; account-status notices (including expiration warnings under Section 10); partner-exit re-accommodation notices (Section 12.4); and notices of material changes to these Terms (Section 15). Service Communications are sent to the email address and/or mobile number you have verified with Journey and are not subject to marketing opt-in or opt-out preferences. You may not opt out of Service Communications while maintaining an active Account; closing your Account is the mechanism for ceasing Service Communications. Journey relies on the performance of its contract with you as the lawful basis for sending Service Communications.

13.2 Marketing Communications. Marketing Communications include promotional offers, member-rate alerts, new Alliance Partner announcements, curated trip ideas, partner promotions, and similar non-essential messages. Marketing Communications are sent only with your prior express opt-in for the applicable channel (SMS or email) and may be withdrawn at any time without affecting your Account or Program membership. Consent to Marketing Communications is not a condition of Program membership.

13.3 Channel-Specific Consent. Marketing consent is collected separately for each communication channel. Opting in to marketing emails does not constitute consent to marketing texts, and vice versa. If you add a new contact method to your Account after enrollment, Journey will request marketing consent for that new channel separately at the time it is added.

13.4 Withdrawing Marketing Consent. You may withdraw marketing consent at any time by (a) replying STOP to a marketing text message, (b) using the unsubscribe link in any marketing email, (c) updating your preferences in your Account settings, or (d) contacting [email protected]. Journey will honor withdrawal requests within the timeframes required by applicable law.

13.5 SMS Program Specifics. Where you opt in to marketing texts: messages are sent using automated technology; consent is not a condition of Program membership; message frequency varies; message and data rates may apply; reply STOP to opt out and HELP for help. See the SMS Terms for details.

14. Data; Privacy

Journey collects and processes personal data to operate the Program. The lawful basis for processing depends on the activity: performance of our contract with you (for Account creation, Points and Status accounting, reservations, and Service Communications); your consent (for Marketing Communications and certain optional features); our legitimate interests (for fraud prevention, security, and Program improvement, balanced against your rights); and legal obligation (for tax, sanctions, anti-money-laundering, and similar compliance). Where personal data is transferred outside your country of residence, Journey relies on appropriate safeguards (such as the EU-US Data Privacy Framework, UK Extension, or Standard Contractual Clauses).

Depending on your country of residence, you may have rights including access, rectification, deletion, restriction, portability, and objection, and the right to lodge a complaint with your local supervisory authority. Journey has appointed representatives under Article 27 of the EU GDPR and UK GDPR; contact details are in the Privacy Policy.

15. Program Changes & Termination

15.1 Changes Generally. Journey may modify earn/redemption structures, tiers, benefits, partners, the Earning Terms, and these Program Terms at any time. Material changes will be communicated through the Services or by email.

15.2 45-Day Advance Notice for Specific Changes. Journey will provide at least forty-five (45) days' prior notice of the following types of changes: (a) addition or increase of fees applicable to the Program; (b) reductions in the minimum guaranteed earn rate for Journey-channel bookings under Section 5.4; (c) reductions in the rate at which Points are earned for ongoing earning methods at Alliance Partners; (d) imposition of caps or limits on Point earning at Alliance Partners; and (e) termination of the Program. Other changes — including additions of new earning methods, new partners, new redemption options, changes affecting Nominated Partner earning rates or structures (which Journey may modify without prior notice), and changes that do not materially reduce Member benefits — may be made without prior notice.

15.3 Termination. If the Program is terminated, Journey will provide reasonable advance notice as required by law and at least thirty (30) days from the date of cancellation notice for Members to redeem Cleared Points, except where forfeiture is permitted under these Terms. Upon termination, unredeemed Points may be forfeited without further liability, except where applicable law requires otherwise.

16. Service Recovery Limits

Where a published elite benefit is confirmed in your reservation and not provided at a participating property upon arrival, Journey may, at its discretion, issue a goodwill remedy (e.g., up to US$50 credit or 5,000 Points) upon request at or before checkout. This remedy is discretionary and exclusive of any other compensation.

17. Disclaimers; Liability

Benefits, awards, and services are subject to availability and may change or be substituted. To the maximum extent permitted by law, Journey is not liable for indirect or consequential losses and, in any event, its total liability related to the Program will not exceed the greater of US$100 or the monetary value of Points the Member redeemed in the three (3) months preceding the event giving rise to the claim. The sole remedy available to a Member in connection with any dispute relating to Points, Status, awards, redemptions, or other Program benefits is as set forth in Section 6.8.

Without limiting the foregoing, Alliance Partners and Nominated Partners are not issuers of, and have no liability for, Points, Status, awards, redemptions, or other Program benefits, as further set forth in Section 5.2. Journey is the sole obligor to Members in respect of Points and Program benefits. Members' rights and remedies in respect of goods, services, or experiences provided by a Partner are against that Partner directly, subject to that Partner's own terms.

Nothing in these Terms limits liability that cannot be limited under applicable law.

18. Governing Law; Dispute Resolution

These Program Terms are governed by New York law (without regard to conflicts). Disputes are subject to individual arbitration and the class-action waiver stated in the Website & App Terms, and to the one-year time bar in Section 16 of the Website & App Terms, except where applicable consumer-protection laws in your country of residence give you mandatory rights to bring claims in local courts or before local authorities, in which case those rights apply notwithstanding this Section 18.
